Privacy Policy

Effective Date: [DATE] Last Updated: [DATE]

This Privacy Policy describes how Bineca LLC, a Delaware limited liability company doing business as Manyclip ("Manyclip," "we," "us," or "our"), collects, uses, discloses, and protects personal information in connection with our website (manyclip.com), client portal (app.manyclip.com), and video editing and creative services (collectively, the "Services").

This Privacy Policy is incorporated into and forms part of our Terms of Service. By using the Services, you acknowledge the practices described here. If you do not agree, please do not use the Services.

1. Scope; Our Role

1.1. Manyclip as a Business / Controller. For information about our clients, website visitors, and prospective customers (e.g., account, billing, and marketing data), Manyclip determines the purposes and means of processing and acts as the "business" or "controller."

1.2. Manyclip as a Service Provider / Processor for Client Content. Footage, audio, images, and other materials our clients upload for editing ("Client Content") may contain personal information about third parties — for example, the faces, voices, and likenesses of people appearing in videos. We process Client Content solely on our clients' behalf and instructions, as a "service provider" or "processor." Clients are responsible for ensuring they have a lawful basis, and any necessary consents and releases, to share Client Content with us. If you appear in a video submitted by one of our clients and have questions or requests regarding that content, please contact the client directly; we will reasonably assist our clients in responding.

1.3. This Policy does not apply to third-party websites, platforms, or services we link to or that you use to publish your finished videos (e.g., TikTok, Instagram, YouTube). Their privacy practices are governed by their own policies.

2. Information We Collect

2.1. Information you provide to us:

  • Account and contact data: name, email address, company name, job title, phone number, password (stored in hashed form), and portal profile details.

  • Billing data: billing address and limited payment information. Full payment card numbers are collected and processed directly by our payment processor (Stripe, Inc.); we do not store full card numbers. We receive payment status, card type, last four digits, and billing metadata.

  • Project data: creative briefs, instructions, feedback, revision requests, brand assets, and communications with our team through the portal, email, or other channels.

  • Client Content: video, audio, image, and text materials you upload for editing, which may include personal information of individuals appearing in or identified by such materials (processed per Section 1.2).

  • Marketing and survey data: information you provide when subscribing to newsletters, responding to surveys, or participating in promotions.

2.2. Information collected automatically:

  • Usage and device data: IP address, browser type, operating system, device identifiers, pages viewed, referring URLs, access times, and interactions with the website and portal.

  • Cookies and similar technologies: we and our vendors use cookies, pixels, and local storage for authentication, preferences, security, analytics, and (where enabled) marketing measurement. See Section 9 (Cookies).

2.3. Information from third parties: payment confirmation and fraud signals from our payment processor; analytics data from providers such as [Google Analytics / analytics provider]; business contact information from publicly available sources or lead providers in connection with B2B outreach; and information from social or login providers if you choose to connect them.

We do not intentionally collect sensitive personal information (e.g., government identifiers, health, biometric, or precise geolocation data) about our clients, and we ask that you not include such information in Client Content unless strictly necessary for the project.

3. How We Use Information

We use personal information to:

  • provide, operate, and maintain the Services, including editing, delivering, and storing your projects;

  • create and administer accounts, authenticate users, and provide the client portal;

  • process payments, subscriptions, invoices, and refunds, and prevent fraud and chargebacks;

  • communicate with you about projects, deliveries, revisions, support requests, and service updates;

  • send marketing communications where permitted by law (you may opt out at any time);

  • analyze usage to improve the Services, develop new features and offerings, and maintain quality control;

  • enforce our Terms of Service, protect our rights, personnel, and clients, and ensure security;

  • comply with legal obligations, including tax, accounting, and lawful requests from authorities.

AI-assisted production. We use a combination of human editors and artificial intelligence tools (e.g., for transcription, captioning, audio cleanup, and quality control) to perform the Services. Client Content processed through AI tools is used to produce your deliverables. We do not permit third-party AI vendors to use Client Content to train their generally available models, and we contractually restrict vendors to processing Client Content solely to provide services to us, except where you expressly agree otherwise.

4. How We Disclose Information

We do not sell personal information for money. We disclose personal information only as follows:

  • Personnel and subcontractors: to our employees, contractors, and vetted subcontractor editors — located in the United States, Indonesia, and other jurisdictions — who need access to perform the Services and are bound by confidentiality obligations.

  • Service providers: to vendors performing services on our behalf, including payment processing (Stripe), cloud hosting and storage, productivity and communications tools (e.g., Google Workspace), analytics, customer support, and email delivery — in each case limited to what is necessary for their function.

  • Legal and safety: when required by law, subpoena, or legal process, or where we believe disclosure is necessary to protect the rights, property, or safety of Manyclip, our clients, or others, or to detect and prevent fraud or security issues.

  • Business transfers: in connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business, in which case personal information may be transferred subject to this Policy's protections.

  • With your direction or consent: for example, when you ask us to deliver files to a collaborator or publish on your behalf.

5. International Data Transfers

Manyclip operates internationally. Personal information and Client Content may be transferred to, stored in, and processed in the United States, Indonesia, and other countries where we or our service providers operate. These countries may have data protection laws different from those of your jurisdiction. Where required, we implement appropriate safeguards for cross-border transfers, including contractual confidentiality and data protection commitments with our personnel and vendors. By using the Services, you acknowledge this international processing.

6. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including to provide the Services, comply with legal, tax, and accounting obligations, resolve disputes, and enforce agreements. As a general matter:

  • Account and billing records: retained for the life of the account plus the period required by applicable tax and corporate record-keeping laws (typically up to seven (7) years).

  • Client Content and project files: retained during the active project and deleted or de-identified approximately [X] days after project completion or account termination, as described in our Terms of Service. We are not an archival service; please maintain your own backups.

  • Marketing data: retained until you opt out or it is no longer needed.

When retention is no longer necessary, we delete, de-identify, or securely archive the information.

7. Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, least-privilege access for editors and subcontractors, and vendor due diligence. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for safeguarding your account credentials. If we become aware of a breach affecting your personal information, we will notify you and applicable regulators as required by law.

8. Your Rights and Choices

8.1. All users. You may access and update your account information through the portal, opt out of marketing emails via the unsubscribe link or by contacting us, and contact us to request access, correction, or deletion of your personal information at [PRIVACY EMAIL].

8.2. U.S. state privacy rights. Depending on your state of residence (including California, Colorado, Connecticut, Texas, Virginia, and other states with comprehensive privacy laws), you may have the right to: (a) know/access the personal information we hold about you; (b) correct inaccurate information; (c) delete your personal information; (d) obtain a portable copy; (e) opt out of "sales," "sharing" for cross-context behavioral advertising, and certain profiling; and (f) not receive discriminatory treatment for exercising your rights.

  • No sale; advertising disclosures. We do not sell personal information for money. If we use cross-site advertising or analytics cookies that constitute a "sale" or "sharing" under California law, you may opt out via [cookie settings / "Your Privacy Choices" link] and we honor opt-out preference signals such as Global Privacy Control (GPC) where required.

  • Exercising rights. Submit requests to [PRIVACY EMAIL] with sufficient information to verify your identity. You may designate an authorized agent where permitted. We will respond within the timeframe required by applicable law and may deny requests where an exception applies (e.g., legal retention obligations). If we deny your request, you may appeal by replying to our decision; we will explain the appeal outcome as required by law.

8.3. Individuals appearing in Client Content. As described in Section 1.2, we process Client Content as a service provider on behalf of our clients. If you submit a request relating to your appearance in a client's video, we may redirect your request to the relevant client and will assist them as required by law.

8.4. EEA/UK and other jurisdictions. Our Services are directed to the United States. If we process personal data subject to the GDPR or UK GDPR, we do so on the legal bases of contract performance, legitimate interests (e.g., service improvement, security, B2B marketing), consent (where required), and legal obligation, and you may have rights of access, rectification, erasure, restriction, portability, objection, and complaint to a supervisory authority. Contact us at [PRIVACY EMAIL] to exercise these rights.

9. Cookies and Analytics

We use the following categories of cookies and similar technologies:

  • Strictly necessary: authentication, session management, security, and load balancing (cannot be disabled).

  • Functional: remembering preferences and settings.

  • Analytics: understanding how visitors use the website and portal (e.g., [Google Analytics]). You can opt out via [cookie settings] or browser controls, and Google offers an opt-out browser add-on.

  • Marketing (if enabled): measuring campaigns and reaching prospective clients. You may opt out via [cookie settings / "Your Privacy Choices"].

Most browsers allow you to refuse or delete cookies; doing so may affect portal functionality. We honor Global Privacy Control signals where legally required. [If applicable: Our website responds/does not respond to "Do Not Track" signals.]

10. Children's Privacy

The Services are intended for business users aged 18 and over. We do not knowingly collect personal information from children under 13 (or the age required by applicable law), and we do not knowingly allow minors to create accounts. If you believe a child has provided us personal information, contact us at [PRIVACY EMAIL] and we will delete it. Clients are responsible for obtaining verifiable parental consent and complying with applicable law (including COPPA) before submitting Client Content featuring minors.

11. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be announced via the client portal, email, or a prominent website notice, with the "Last Updated" date revised above.
